There is no quota of grandchildren of freedom fighters in DU

A legal notice has been issued for canceling the freedom fighters’ grandchild quota, the pet quota for the children of teachers-officers and the open house quota for admission in the 2024-25 academic year of Dhaka University. It has been asked to cancel all other quotas while retaining 5 percent quota for the ‘children’ of freedom fighters, martyred freedom fighters and heroes, 1 percent for minority ethnic groups and 1 percent for physically challenged and third gender.

Supreme Court lawyer Barrister Solaiman Tushar has sent this notice by e-mail to Dhaka University, Dhaka University VC, Pro-VC (Administration), Pro-VC (Education) and Registrar.

It has been informed that if the Dhaka University authorities do not take action in this regard within five days of receiving the notice, legal action will be taken on the matter including a writ in the Supreme Court. The notice said, Dhaka University is a symbol of hope and aspiration of the Bengali nation. Since its establishment, students, teachers and officials of Dhaka University have contributed to all democratic and human rights movements. The role of students-teachers and officials of Dhaka University was unforgettable in the quota reform movement of July-August 2024 and the overthrow of Sheikh Hasina government.

The notice further states that the admission process of a public university must be based on merit and admission process of a public university on any other criteria is generally discriminatory, arbitrary and unreasonable. It has no logical connection with any legitimate state objective.

Referring to the freedom fighters’ grandchild quota in violation of the Constitution and the Supreme Court’s verdict, it said that the highest court of the country has set only 5 percent quota for the children of freedom fighters, martyred freedom fighters and veterans in government, semi-government and autonomous institutions. This judgment should also be applied in the admission process of Dhaka University. It is contrary to the Constitution and the judgment of the Supreme Court to create an opportunity for admission in the quota of freedom fighters’ grandchildren.

Referring to the discriminatory domestic quota, the notice said, under Article 28 (04) of the Constitution of the People’s Republic of Bangladesh, special provisions may be made in favor of women or children or for the betterment of any backward section of citizens. The sons and daughters of Dhaka University teachers and employees do not meet that criteria. Therefore, reservation of 1 percent in ward or pet quota in the admission process of Dhaka University is discriminatory, arbitrary and unreasonable.

Besides, demanding cancellation of player quota, it is said that there are allegations of irregularities in the admission of players in the quota. Moreover, the quota of players does not fall under the backward category as defined in the constitution. Therefore, the special quota for sportspersons in the admission process of Dhaka University is also in conflict with the constitution and contrary to the judgment of the Supreme Court. Besides, there is scope for nepotism and corruption in player quota.
